There is Still a Penalty

With all the confusion surfacing around repeal and replace, we want assisters and consumers to be clear - THE LAW IS STILL THE LAW. The Affordable Care Act is still the law of the land and there is still a penalty associated with not having coverage. Read the IRS's Shared Responsibility provision here.Individuals who do not have insurance in 2017 and who do not qualify for an exemption will be subject to a penalty when they file their taxes. For 2017, the penalty amount is either a percentage of household income or per person, whichever is higher:

  • Percentage of income.2.5% of household income; Maximum: Total yearly premium for the national average price of a Bronze plan sold through the Marketplace
  • Per person. $695 per adult; $347.50 per child under 18; Maximum: $2,085

The tax penalty amounts for not having insurance in 2018 have not yet been announced.

 

IRS To Begin Rejecting "Silent" Returns
The Internal Revenue Service (IRS) continues to enforce the individual mandate that requires people to have health insurance, be eligible for an exemption, or pay a penalty at tax time. Taxpayers are supposed to answer a question on their tax return indicating whether they had health insurance during the tax year. In previous years, the IRS has accepted tax returns even when the taxpayer failed to answer the question about health coverage. Taxpayers who submitted these "silent" returns were subject to a request for follow-up information from the IRS. However, beginning with the 2018 tax filing season, the IRS will reject "silent" returns that fail to specify whether the taxpayer had health insurance in 2017. Ready, Set, ENROLL

With only five days left until Open Enrollment starts, Healthcare.gov has published the 2018 Marketplace Plans and Prices tool for consumers to preview estimated costs for the 2018 enrollment period. Consumers will have until Dec.15 to enroll in coverage for 2018. Due to the2018 Marketplace Final Rule, consumers who did not pay past due premiums to health plan insurers in 2017, if they chose the same insurer for 2018, may receive a bill for those past due premiums along with their January invoice. For consumers wishing to enroll in off-marketplace plans, the PA Insurance Department and Consumer Checkbook site, PA.CheckbookHealth.org, will compare plans both on and off of the marketplace for consumers to preview and enroll. The Insurance Department has also launched an advertising campaign and an Open Enrollment Resource page to assist consumers and enrollment assisters. It features ACA enrollment commercials, videos, Marketplace guides, posters and other materials, all of which are available for download.
